“The deaths appear to have resulted because a refrigeration unit attached to the trailer carrying the individuals malfunctioned and failed to cool the interior of the trailer,” states a new motion filed by Jose Gonzalez-Falla, a public defender representing Zamorano.Homero Zamorano Jr., the alleged driver of the semi-trailer whose journey from Laredo to San Antonio left 53 immigrants dead.

The motion said prosecutors expect that it could be months before the Bexar County Medical Examiner’s Office completes autopsy reports for the 53 migrants. It said the government might take months to decide whether to pursue the death penalty and that the defense may need to obtain and review footage from more than 50 body cameras of San Antonio police officers who went to the scene.

“Though only two men have been charged, the facts show an international human trafficking organization was involved,” the motion said. “Officials in Honduras, El Salvador, Guatemala, and Mexico are assisting federal authorities investigate the offense. In Texas, local, state, and federal law enforcement agencies seek to identify and apprehend those participants in the United States.”
