Lawyers for the then-Brazos County Jail inmate, Gabriel Paul Hall, said jail officials gave Ross and his Comedy Central film crew access to their client despite their explicit request that his legal team be contacted before anyone spoke to Hall.
Standing in a rubber-padded isolation cell over a hole in the ground that served as a toilet, Ross even got a detention deputy to concede, on camera, that solitary confinement could be considered torture. Hall’s lawyers said his Sixth Amendment right to an attorney was violated by the jail allowing the crew to have unfettered access to their client, who made several statements they say could have contributed to the jury’s decision to sentence him to death. After previous appeals at the state level failed, Hall’s attorneys escalated the issue to the U.S. Supreme Court.
Hall’s lawyers did not respond to an email seeking comment. Neither did Ross, his agent, or a spokeswoman for Comedy Central’s parent company, Paramount Global. When Ross arrived to the jail in February 2015 to film the special, Hall had been incarcerated and awaiting trial for more than three years. The first day of filming, Ross and the crew walked into the high-security wing of the jail where Hall was housed. Ross asked Hall what he had done to land him in jail.
Ross said Hall seemed like a “[expletive] scary dude,” according to the transcript. Hall responded he wouldn’t hurt a fly.Ross also made several comments about Hall, who was born in the Philippines, that Hall’s lawyers said could inflame any anti-Asian prejudices jurors might have.
