"Defendant's betrayal of the oath he took to serve and protect and the trust placed in him by the community, even in his off-duty conduct, reasonably relates to the circumstances under which the crime was committed and makes his conduct significantly more egregious," the prosecutors wrote. Authorities said police investigating the alleged attack in 2018 entered Rodriguez's DNA into the state's DNA database, resulting in a "cold hit" notification involving the 2015 attack.
