Jersey City plans to appeal the recent decisions.

The state Civil Service Commission has rejected Jersey City’s position that it can fire police officers for using recreational cannabis, the third consecutive setback for the city.

Last year state Attorney General Matt Platkin reiterated the directive that went into effect after the first legal cannabis shops opened. In her June Office of Administrative Law decision on Police Officer Norhan Mansour, Judge Kimberly Moss said the city can’t enforce federal law to the exclusion of obeying its own obligation under state law.

“We are happy that the Civil Service Commission and Judge Candido correctly applied the law, confirming that the New Jersey Constitution and CREAMM Act prohibit law enforcement agencies from taking adverse employment action against police officers because they legally use regulated cannabis off-duty,” said attorney Michael Rubas, who represents both Mansour and Polanco. “My clients look forward to their immediate reinstatement, back pay, and award of counsel fees.
