A district court judge in Mesa County has ordered a new trial for the man convicted of killing two people in a series of pipe bombings in Grand Junction three decades ago, finding that the man was convicted based in part on faulty evidence
Genrich, who was 28 at the time, was found guilty at trial after an expert for the prosecution told the jury that marks on the bombs must have been made by Genrich’s tools. The expert testified that his analysis ruled out the possibility that any other tools could have made the marks.
“The court finds that the conclusion that the defendant’s tools caused the cuts to the wires from the bombs to the exclusion of every other tool was a crucial piece of evidence in the defendant’s case and without it, the people’s case would have been almost entirely circumstantial,” he wrote. Genrich was represented in his appeal by attorneys from the Innocence Project, a nonprofit organization dedicated to exonerating wrongly convicted people.
After the convictions are wiped clear, Genrich still will face the two murder charges, and will be held in custody on those charges, Rubinstein said. Because of a recent, Genrich will be eligible for bail. Rubinstein said he will ask for an amount so high that Genrich will not be able to pay it and he will be kept in custody.
Genrich was living in downtown Grand Junction and working at the Two Rivers Convention Center when a bomb went off in the center’s parking garage on Feb. 14, 1991. A man was injured but no one was killed in that bombing.
