Garcia’s mother, Bertha Garcia, got into an argument with Ramos, her husband, because he did not answer her phone calls and text messages in the hours before he arrived home, testimony established.Both had been drinking heavily, she testified, and her two sons, one 14 at the time, and Jarren, whom she calls Diego, intervened when they heard yelling and saw Ramos pour a beer over her face.
She and fellow prosecutor Oscar Peña tried to undercut the self-defense claim by pointing out that Garcia shot Ramos six times — including once in the back of the leg — and that a trail of shell casings and unspent rounds indicated he followed his target, shooting at him both inside and outside the house.“This was about the impulsiveness of a young man that didn’t like how he was talked to,” Mulliner told the jury. “Those are words. Not deadly force.
