“How much would you pay for one more day with dad?” an attorney for Luke Stewart's family asked during closing arguments in the civil trial over Stewart's shooting by a Euclid police officer.
CLEVELAND, Ohio -- A jury should make the Euclid police officer who shot and killed an unarmed man after jumping into his car in 2017 pay $11.5 million to the man’s surviving family members, attorneys for the man’s estate said in court Monday.
Rhodes fatally shot Stewart at the end of a 57-second interaction on March 13, 2017 that attorneys for Stewart’s family said was marred by Rhodes making a series of reckless and dangerous decisions. Catalani opened the driver’s door, grabbed Stewart by the head and started trying to yank him out of the car, he testified. Rhodes testified that he opened the passenger door and leaned inside and started trying to push him out.
Stewart and Rhodes both grabbed for the gearshift as Stewart drove toward East 222nd Street and the carRhodes testified that he punched Stewart in the face several times, then pulled out his Taser and shot its probes into Stewart’s shoulder as the car continued moving. Stewart continued fighting for control of the gear shift, so Rhodes hit Stewart in the head with the Taser. Rhodes then pulled out his gun and shot Stewart three times in the chest.
Rhodes also acknowledged on cross-examination that the car was in neutral when he shot Stewart and that Stewart never hit Rhodes back until after he fired the shots into Stewart’s chest.
