The two plaintiffs said they were afraid to provide information about abortion clinics located in states where the procedure is legal because of statements made by Alabama Attorney General Steve Marshall.

Alabama Attorney General Steve Marshall talks about a bill that would increase penalties for crimes committed on behalf of "criminal enterprises." Two clinic owners in Alabama and the ACLU filed a lawsuit Monday seeking to prevent prosecutions of people who provide information or assistance to women who want to travel out of state to get abortions.

The speculation about prosecution has centered on an 1896 criminal conspiracy law. It makes it illegal to conspire in Alabama to commit a crime in another state. However, the plaintiffs say the law doesn’t apply to abortion if it is legal in the state where it is performed. In addition to the attorney general, the lawsuit names all of Alabama’s local district attorneys as defendants.

“The attorney general’s threat to prosecute people for assisting and supporting Alabamians in seeking out-of-state abortion care is as dangerous as it is blatantly unconstitutional,” said Meagan Burrows, staff attorney for the ACLU Reproductive Freedom Project.
