The Lebanon County chapter of the NAACP has filed a legal complaint seeking disciplinary action against District Attorney Pier Hess Graf for her failure to thoroughly investigate the deadly shooting of two people by a Pennsylvania State Police officer.

Charity Thome was shot and killed on May 16, 2020 after she was found trying to break into the home from which she’d been evicted and fled. A chase ensued and police saidtried to use her car as a weapon after Splain forced her car off the road and into a Lebanon County field. “Though her office is tasked with investigating police misconduct, District Attorney Graf serves more as a fox guarding the henhouse,” the NAACP said in its letter to the Supreme Court disciplinary board. “While her professional obligations require her to enforce the law fairly and impartially, her actions clearly demonstrate that her thumb is on the scale in favor of the police, not the citizens whose constitutional rights she is bound to protect and uphold.

Graf noted that the investigation into Dzwonchyk’s shooting is ongoing. She said she stands “behind the caliber of each man” in the investigative unit.
