Texas Attorney General Ken Paxton’s defense team argues that corruption allegations against him should be dismissed due to their vagueness. They also claim that House managers have drawn incorrect conclusions and displayed a lack of understanding of the Attorney General’s Office. Paxton is accused of seeking a legal opinion that would benefit Nate Paul.
They further argued that in the case against him, House managers drew “demonstrably wrong conclusions of law ” and “demonstrate an almost alarming ignorance of how the Attorney General’s Office even works.”In one instance, for example, Paxton is accused of having Bryan Hughes, R-Mineola, ask for a legal opinion that would prove beneficial to Paul. Paxton’s defense team insisted that nothing was wrong with that practice.
Additionally, they argued that the House managers failed to list the whistleblowers by name in the article accusing him of misapplication of public resources. Paxton’s lawyers also accused them of misinterpreting state whistleblower laws. The fact that his impeachment originated with his request for the whistleblower settlement funds was egregious, they added: “The House has done violence to our democracy by preferring an Article of Impeachment to express its displeasure over a routine settlement of ordinary employment litigation.”The decision to dismiss any articles of impeachment will be up to the Senate. Paxton’s wife, Sen. Angela Paxton, has been forced to recuse herself from any votes during the upcoming tribunal.
Conflict of interest concerns were raised against several other senators, including Hughes and Donna Campbell, R-New Braunfels, who appears to have employed the woman with whom Paxton allegedly had an affair. Neither has been forcibly recused.that Paxton asked to be removed, citing alleged bias against him.
In their single motion filed Saturday, the House managers wanted to clarify several rules for the September trial. Specifically, they argued that Paxton and his legal team will be allowed to use their cell phones while they will be barred.“To fully perform their job as prosecutors, the House managers will need access to personal electronic devices,” they wrote.
