The National Transportation Safety Board has recommended a .05 limit since 2013, but Utah is the only state to adopt it so far.

Make your contribution now and help Gothamist thrive in 2023.New York City’s top transportation official on Tuesday urged state lawmakers to pass a bill lowering the state’s DWI limit to .05, saying the state has historically been too slow to act on drunken driving laws.

That was up from the prior three-year average of 27 per year, according to the city. Statewide, about 30% of fatal motor vehicle crashes are alcohol-related,“This is not about going after anyone that wants to have a drink,” Rodriguez said. “If you have a drink, if you want to have a drink, get an Uber, get a taxi, but please don't drink and drive.”

There's a range of penalties for those found to be driving while intoxicated. Drivers who register a BAC of .18 or higher can face an aggravated DWI charge, which carries a max jail sentence of one year. Repeat offenders can face seven years in prison.

Safety Board: Mechanical Defect Caused Ohio Train WreckSafety Board: Mechanical Defect Caused Ohio Train WreckA smoldering fire has persisted in a tangle of dozens of freight cars — some carrying hazardous materials — that derailed in Ohio near the Pennsylvania state line. An evacuation order remained in effect and environmental authorities kept a wary eye on air quality monitors. Federal investigators confirmed Sunday that a mechanical issue with one of the car’s axles caused about 50 cars to derail in East Palestine at about 9 p.m. Friday. No injuries to crew, residents or first responders have been reported. East Palestine officials said emergency responders were monitoring but keeping their distance from the fire. Officials say the evacuation zone covered a 1-mile radius. Schools and village offices will be closed Monday.
