Opinion: Theranos founder Elizabeth Holmes should remain free pending appeal [Opinion]
Re “Elizabeth Holmes has second child as prison sentence looms” : If Elizabeth Holmes’ conviction is upheld on appeal, she will end up spending more than a decade in custody. As a federal prosecutor with more than 40 years’ experience, I recognize that people can in good faith debate the appropriateness of this sanction.
Yet such a debate does not mean there is no significant basis for appeal, and it certainly does not mean that Holmes is a flight risk. Indeed, I find it particularly troubling that the government has chosen to distract and obfuscate from the purely legal determination related to the merits of her conviction by raising spurious allegations related to her risk of flight.Given the short amount of additional time it will take for her conviction to be reviewed, it would be appropriate to allow her to remain at liberty just a bit longer until a final judgment is entered.
