Right-wing pundits and at least one Republican lawmaker condemned a Manhattan grand jury’s decision Wednesday to indict Daniel Penny, who was captured on video holding Jordan Neely in a fatal chokehold on a New York City subway last month—a case that has sparked a racially fueled partisan debate about self-defense and the roots of big city crime....

Rep. Ronny Jackson said “Penny did nothing wrong” and “shouldn’t be charged with anything,” in a tweet Thursday, calling Manhattan District Attorney Alvin Bragg “a disgrace to this country,” though it was an independent grand jury, not Bragg, that voted to indict Penny. Some right-leaning media hosts suggested Penny was indicted because he is white : “You have a white guy protecting Black people from a Black guy and a Black prosecutor wants to put that white guy in jail,” Fox News host Jesse Watters said Wednesday, comparing the case to other controversial cases in which white defendants alleged they were acting in self defense.

Some conservatives also blamed the indictment on the political makeup of New York City, where the large majority of registered voters and elected officials are Democrats: “If you try to stand up to a criminal in Blue cities, your leaders’ will find every excuse they can to side with the criminal,” conservative radio host Charlie Kirk tweeted, while conservative pundit Ben Shapiro called the indictment “the woke lynching of Daniel Penny,” invoking a method used to kill and terrorize Black people...

Other pundits called Penny a “hero,” while claiming, without evidence, that Neely “was probably, allegedly on drugs, he was violent, he scared everybody on that train to death,” conservative radio host Sid Rosenberg said during an appearance on Fox News, though witnesses have reportedly said Neely had not become violent and was not threatening anyone in particular.Following Penny’s arrest in May, Republican presidential hopefuls spoke out in his defense.
