The amended complaints, which seek to recover the $9.4 million that broker Jason Hughes was paid as well as punitive damages, came three weeks after a judge suggested the city rewrite its claims.

Two long-standing lawsuits over the city of San Diego’s leases for the 101 Ash St. and Civic Center Plaza high-rises have been redrafted and refiled in Superior Court, weeks after a judge strongly suggested the cases be amended.

Hughes has said he informed at least six city officials that he planned to seek payment for his consulting work advising the city. He has cited a letter he sent to then-real estate director Cybele Thompson in 2014, which she accepted and signed. It added Hughes and other defendants to the litigation in 2021 after learning that Hughes had signed a confidential agreement with Cisterra to share profits from real estate deals.

The city’s settlement agreement also indemnified Cisterra and CGA Capital, meaning the city is now responsible for their associated legal costs. Dick Semerdjian, one of numerous lawyers the city hired to handle the Ash Street lawsuits, disagreed with Taylor during the hearing but agreed to refile the claims.“For the avoidance of doubt, in no event shall Hughes or Hughes Marino be deemed a Cisterra entity for purposes of the settlement agreement and the release of Cisterra entities in the settlement agreement,” the refiled complaints state.
