Competing defamation lawsuits now have been filed over a digital dossier that sparked controversy in the Scottsdale Unified School District, with parents claiming the district violated their free speech rights.

They further claim the Greenburgs and school district officials retaliated against them for exercising their First Amendment right to speak out. The lawsuit claims Jann-Michael Greenburg and district officials relied on Mark Greenburg to monitor, intimidate and silence critics. Since Greenburg's Google Drive came to light last fall, a stream of Republican candidates for statewide offices have visited board meetings in support of conservative parents.

The suit claims Jann-Michael Greenburg and the district supplied him with information, such as unredacted copies of emails exchanged between Wray and the superintendent and unredacted emails Stafford sent to the district. The lawsuit repeatedly refers to these as"private communications." The suit questions how Menzel could have monitored the Facebook group if he was not a member, and claims it was via Mark Greenburg's Google Drive. The suit points to a computer screenshot Menzel emailed to himself that was also on the drive. in February found the superintendent and three school board members did not use district-issued computers in connection with the Google Drive, and saw no activity related to it on the district's email server.
