The major questions doctrine has two parts — one focused on whether the subject has a major impact on the nation’s economy or on the public, and the second is whether a federal agency has explicit authority to implement new regulations.“On the first pillar, regulation of crypto assets is a matter of great economic and political significance. It is the subject of dozens of recent Congressional hearings and legislative proposals,” Lummis said, citing the growth of crypto’s value over the years.
