Maybe Ted Cruz should have stayed in Montana this week.

“I think you’re the only Supreme Court nominee in history who has been unable to answer the question,” Cruz scolded his former Harvard Law School classmate. Cruz conveniently ignored the fact that, until quite recently, Supreme Court nominees fielded thoughtful questions at their confirmation hearings, rather than the type designed to elicit a viral clip or “gotcha” moment.

There was Josh Hawley of Missouri, sounding the alarm about Jackson’s supposed “leniency” in dealing with child pornography offenders. Lindsey Graham of South Carolina, asking nosy questions about Jackson’s church attendance, even after Jackson politely reminded him that there is no religious test for public office in the United States. And so on.

They shouldn’t. Jackson is “eminently qualified” for the high court, argued conservative Judge Michael Luttig, a mentor of Cruz’s, in a statement on Jackson’s nomination. Some conservatives, after watching the hearings, also had the sense that Jackson is the best nominee they could hope for from a Democratic president. Jackson is considered likely to be one of the court’s three liberals; she described Roe v Wade, the landmark 1973 decision establishing a constitutional right to an abortion, as “settled law,” during the hearings.
