Alito Jr. and Justice Clarence Thomas both issued dissenting opinions and said that states were allowed to enact laws “restricting participation in women’s or girls’ sports based on genes or physiological or anatomical characteristics.” Her lawyers sued after HB 3293 took effect in 2021 and have been fighting for Pepper-Jackson’s place on her school’s sports team ever since. “This was a baseless and cruel effort to keep Becky from where she belongs — playing alongside her peers as a teammate and as a friend,” Pepper-Jackson’s lawyers said in a statement after the Supreme Court’s decision.a preliminary injunction
