Cho left the bar for “about 15 minutes” before returning and again asked for a drink, the affidavit states. When Wargny refused, Cho shot her multiple times. Cho also shot at a person who restrained him, but they were not struck by gunfire, the affidavit states.
Yuan Ying Tsui, who works at a Chinese restaurant next door to Happy Day, said Cho came to the restaurant around dinner time on the same day as the shooting. Court records showed that Monday was not the first time Cho has been accused of a crime involving alcohol. The owner of the restaurant told officers Cho, who was intoxicated, came into the business and wanted to continue drinking. When the restaurant refused to serve him, Cho “became very angry and began swearing and yelling at customers,” the affidavit states.
