AUSTIN – Gov. Greg Abbott says it is illegal for state agencies and universities to consider “diversity, equity and inclusion” in employment.

The one-page letter was sent to the Employees Retirement System of Texas on Feb. 4, though other letters were sent to multiple agencies on Monday. The letter also noted that DEI initiatives could not be used when starting a new department or office in state agencies.DEI policies are meant to create a welcoming culture for people who have been historically underrepresented or discriminated against in the workplace because of factors such as their race, gender or sexual orientation.

It is not clear how Texas state agencies and public universities are meant to respond. At least two – the Texas Department of Public Safety and University of Texas at Austin – have active postings for DEI-related jobs. Neither immediately responded to a request for comment. A commission spokesperson did not respond to requests for comment Wednesday on whether the governor’s office directed the decision or whether it was connected with Pate’s letter., alleging it was using “discriminatory, illegal, and anti-meritocratic practices” in its faculty fellowship program aimed at boosting diversity, according to the lawsuit.
