The night of the crash, Mabry had seven and a half drinks in 74 minutes, prosecutor Andrew James said. His blood alcohol content was 0.139 at the time of one toxicology test. The legal limit to drive in Texas is 0.08.during victim-impact statements as she recounted the effect of the fatal crash on her 5-year-old son, Cashton. Mitchell Penton was raising Cashton as his own and the two were best friends, she said.
