The 6-year-old Virginia boy who shot his first grade teacher will likely not face charges, according to experts. However, the parent's of the boy could under gun safety laws.
A Richneck Elementary School parent said he has previously talked to school staff members about safety concerns prior to Friday’s shooting. 10 On Your Side reports.his Virginia teacher Friday with a gun he took from home is unlikely to be charged, but his parents could be criminally culpable depending on how the firearm was stored, experts say.
A judge would also have to find that the child was competent to stand trial, meaning that he could understand the legal proceedings against him and assist in his own defense, Andrew Block, a professor and the University of Virginia School of Law who was the director of Virginia’s Department of Juvenile Justice from 2014 to 2019, told the Associated Press.

However, Virginia does have a misdemeanor law meant to protect children 14 and younger from access to firearms.,"any person to recklessly leave a loaded, unsecured firearm in such a manner as to endanger the life or limb of any child under the age of fourteen," is guilty of a Class 1 misdemeanor. According to state law, punishment for a Class 1 misdeamor includes up to twelve months in jail and/or a fine up to $2,500.
Drew shared that he wanted to clarify remarks he made just after the shooting on Friday, when he said there was an"altercation" before the shooting. He said it was more like an"interaction" between the boy and his first-grade teacher at Richneck Elementary School, 25-year-old Abby Zwerner.
