West Shore School District files to dismiss curriculum lawsuit, enact gag order

The case was initially filed in the Cumberland County Court of Common Pleas, although the West Shore School District straddles Cumberland and York counties. West Shore School District’s board voted in July 2022 to adopt Character Strong – a curriculum published by a Washington-based company which teaches children social skills that develop “thoughtful, healthy, and kind human beings,” according to its website.

According to emails provided as plaintiffs’ evidence, one of the parents sent a list of questions to the district asking if it would be teaching certain issues of race or gender that their conservative, religious family found objectionable.“not every human is deserving of my child’s empathy,” However, the school district noted in its federal motion this week that “plaintiffs’ children are exempt from the curriculum at issue during the pendency of this litigation,” thus obviating the plaintiffs’ request for immediate relief that their children be removed from any Character Strong lessons.

The school district has also asked the court to place a gag order prohibiting the parties in the case from making any statements to the press or public about the case, citing that possibility that “publicity in this case could have a substantial effect on the ability to assemble a fair and impartial jury” were the case to go to trial.
