Dewey Green, the grandson of former Birmingham Mayor W. Cooper Green, was sentenced to 40 years in prison this week for felony murder and three counts of aggravated assault.

now 31, was initially convicted in 2015 and sentenced to life without parole in the 2014 death of 53-year-old Janice Pitts.ruling that a trial court excluded a key witness’ testimony that might have affected the jury’s guilty verdict.

“This is a case that shocked our community. A grandmother, a law-abiding citizen, driving her daughter to work was senselessly and brutally run over and murdered by the defendant,’’ said Douglas County District Attorney Dalia Racine. He backed up and rear-ended her vehicle again, and then a third time. When Pitts got out of her vehicle to check for damage, Green used his vehicle to pin Pitts between her vehicle and his, and then backed over her.

Green’s attorneys said the Pelham native had a head injury that caused a seizure after getting into a fender bender with Pitts, and that he wasn’t in control when he struck Pitts. Law enforcement officials in Alabama said in 2015 they were familiar with Green. He was arrested in 2009 but was granted youthful offender status so authorities couldn’t discuss the case or even the charges against him. He was also the subject of a harassment probe in 2011 involving the Caritas of Birmingham, a ministry based in Shelby County, but no charges were ever filed against him in that case.
